Rental Agreement
1. USE. Lessee shall use the leased property in a careful and proper manner within a 25 mile radius of our store location and shall comply with all laws, ordinances and regulations which relate in any way to the possession, use and/or maintenance of the leased property. Rental rates apply for a full 8 hour day, 40 hour week (5 day week.)
2. COST OF DELIVERY AND PICK-UP: The cost of $125.00 delivery/pick-up fee shall be the responsibility of Lessee.
3. SECURITY DEPOSIT. Prior to taking possession of the Equipment, Lessee shall deposit with Lessor, in trust, a security deposit of $300.00 as security for the performance by Lessee of the terms under this Agreement and for any damages caused by Lessee or Lessee’s agents to the Equipment during the Rental Term. Lessor may use part or all of the security deposit to repair any damage to Equipment caused by Lessee or Lessee’s agents. However, Lessor is not just limited to the security deposit amount and Lessee remains liable for any balance. If Lessee breaches any terms or conditions of the Agreement, Lessee shall forfeit any deposit, as permitted by law.
4. INSURANCE: Lessee is responsible for carrying the highest amount of insurance available for the leased property, including: fire, theft, personal injury, damage & public liability; and shall hold the other party harmless there from.
5. SURRENDER AND RETURN: The leased property shall be inspected by the Lessor and Lessor will notify the Lessee of any defect or objection as to the condition of the leased property. Lessee shall be responsible for restoring the leased property to the condition it was in, or better, when leased. The Lessee is responsible to return the equipment with a full tank of fuel or Lessor will charge the Lessee the cost of fuel.
6. SERVICE CALL: If Lessee for any reason is unable to operate the listed equipment and requires one of John S. Blazey, Inc. employees to assist in teaching how to operate the equipment, will render a $125.00 service fee.
